
Erika Jayne is going from The Real Housewives of Beverly Hills to an upcoming trial.
The reality star failed to settle out of court with the trustee of estranged husband Tom Girardi’s now-defunct law firm over $25 million that the law firm allegedly spent on her.
The judge has set a trial date for February 10th, according to court documents, bringing this whole ordeal to a head.
Jayne Faces $25m Lawsuit
A recent court document has been revealed by attorney Ronald Richards on Instagram detailing the broken-down settlement talks and upcoming trial.
“Settlement talks have broken down completely between [Erika Jayne] and the Trustee. A motion was also filed to gut any remaining defenses she had due to admissions in the Psaila case. Petrial hearing is less than 30 days away with a 2/10/26 trial date now a real thing. Erika has little options. Panic sitting in.”
The Psaila case Richards mentions calls back to when Jayne was accused of falsely claiming that Christopher Psaila’s design firm, Marco Marco, made $800,000 in fraudulent charges to her American Express card. Psaila retaliated with an $18 million lawsuit.
She may also be heading to trial in that case, too.
Girardi Files for Bankruptcy
The lawsuit originated all the way back in 2020, when Girardi was accused of embezzling millions from vulnerable clients, such as widows and orphans, and other third parties.
In June of 2025, Girardi was sentenced to 87 months (7 1/4 years) in federal prison. After beginning his sentence, a trustee stepped in to take control of the law firm’s finances and collect the money owed to Girardi’s victims.
While looking through the paperwork, the trustee filed a lawsuit against Erika Jayne.
Jayne divorced from Girardi back in 2020 and has long denied any involvement in his crimes, but now she’s in the spotlight again, with more evidence of her potential involvement.
Her Part in the Bankruptcy
While the trustee was reviewing the firm’s finances, they alleged that more than $25 million was used to cover personal expenses from Erika’s entertainment company, EJ Global, over 12 years. This would be back in 2008 when it all started. Many of the payments included glam squads, luxury shopping, credit card bills, and jewelry.
In response to these findings, the trustee wrote, “The payments by [Girardi’s law firm] were exclusively for the benefits of [Jayne and her company]. The expenses consist largely of expenses to promote Erika personally.”
Records reveal over $14 million in American Express charges made by Jayne, and an additional $11 million in vendor benefits, those also allegedly for her benefit.
The trustee added, “Erika either signed or authorized every charge made to the relevant American Express accounts and approved all vendor payments, knowing that she had no ability to pay for the charges and invoices.”
The total debt accrued? $25 million.
Going on the Defensive
Jayne and her lawyer have gone on the defensive against the trustee. They claim she never did anything wrong in the eyes of the government, as she wasn’t “called as a witness.”
The reality star has also denied she had no knowledge “about or participated in any of the misconduct of Tom Girardi or [his law firm] toward their legal clients.”
The trustee was not convinced, stating, “Erika’s assertion of innocent spouse status is meritless. As [Girardi’s] spouse, she qualifies as an insider … The defense is further defeated by Erika’s own affirmative misconduct. Erika either signed or authorized every charge made … knowing she had no ability to pay for the charges and invoices.”
With her divorce still in the air and a $25 million lawsuit trial on the horizon, Jayne’s life is sure to be full of ups and downs. It will surely be seen on the next season of RHOBH.
